WHEN TO FILE THE BOARD OF IMMIGRATION APPEAL?

The Immigration Judge will inform the non-citizen of their right to Appeal after the denial of the relief.  The Notice of Appeal must be received within 30 after the Immigration Judge's Oral decision was made or the written decision was mailed. Upon finding that a Respondent is removable and ordering the Respondent removed, the Immigration Judge will give the Respondent a Notice of Appeal (Form E0IR-26), and advise the Respondent of his or her right to appeal within 30 days. The Respondent should seek legal counsel immediately after the Immigration Judge denies relief and informs the Respondent of right to Appeal Ruling.

 CAN THE RESPONDENT WAIVE HIS RIGHT TO APPEAL?

An Order of Removawl made by the Immigration Judge at the conclusion of proceedings under Sec. 240 of the Immigration and Nationality Act (8. U.S.C. 1229a.) shall become final upon the Respondent waiving his right to Appeal 8 C.F.R. Sec. 1241.1.   The Respondent should consult an immigration lawyer and explain the specific facts of the case before waiving the right to appeal. Immigration law is not interpreted in a vacuum. Most Immigration Court Hearings are heard at Newark Immigration Court 970 Broad Street, Rm. 1200 Newark, NJ. 07102.  In the past, Elizabeth Detention Center located at 625 Evans Street, Elizabeth, NJ. 07201 held Immigration Court Hearings. However, Immigration information is dynamic. At one time the hearings due to COVID 19 were being held remote via Webx. However, recently counsel has been getting for clients Notices to Appear in Person.

The Respondent should consult their NTA or Notice to Appear to find out what court the hearing is located; and Respondent's must inform the court of a change of Address. The Court will Order removal in Absentia for non-appearances that present many problems for the Respondents.
