WHAT DETERMINES THE SENTENCE OF AN INDICTABLE CRIMINAL CHARGE IN NJ.?
N.J.S.A. 2C:43-6 establishes the general Terms that the Essex County N.J. Superior Court Criminal Division will sentence criminal defendants convicted of a felony charge.
- First degree for a specific term of years between 10 years and 20 years
- Second degree for a specific term of years between 5 and 10 years
- Third degree for a specific term of years between 3 and 5 years
- Fourth degree for a specific term of years not to exceed 18 months.
- Generally, a presumption of no incarceration of first offenders found guilty of Third Degree, Fourth Degree, Disorderly Person. N.J.S.A. 2C:41-1(e)

WHAT IS LIFE IMPRISONMENT WITHOUT PAROLE IN NEW JERSEY; EXTENDED TERM FOR REPEAT VIOLENT OFFENDERS?
N.J.S.A. 43-7.1 explains generally the meaning of life without Parole: A person convicted under N.J.S.A. 11-3 (Criminal Homicide) (Murder); subsection (a) of N.J.S.A. 11-4(a) (Aggravated manslaughter); crime of the first degree under N.J.S.A. 2C:13-1 (Kidnapping); N.J.S.A; paragraphs (3) through (6) of subsection (a) 14-2 N.J.S.A.; Aggravated Sexual Assault; and N.J.S.A. 15-1 (Robbery) are all predicate serious violent crimes which subject repeat offenders to Life Imprisonment without Parole.
The above-mentioned criminal defendants must have been convicted of two or more crimes committed on prior and separate occasions regardless of the dates of conviction under the forgoing Statute or any similar Statute in the United States. (Three Strikes Law) Moreover, the New Jersey Supreme Court recently ruled in State v. Samuel Ryan, (A-65-20) Decided on February 7, 2022, that defendant's prior juvenile-age conviction counts as a predicate offense under the Three Strikes Law for the purposes of enhanced sentencing of Life Imprisonment without Parole.
The term life for the purposes of the above section means a person's natural life. Except that a defendant who is at least 70 years of age and has served 35 years in prison shall be released on parole if the full Parole Board determines that the defendant is not a danger to any other person in the community.
